12/06/2004 ORDER-RELINQUISHMENT (MISC)   The Motion to Withdraw as Counsel for Appellant and Motion to Stay Proceedings filed in the above cause by Kenneth M. Malnick is granted. We therefore temporarily relinquish jurisdiction of the above cause to the Circuit Court of the Seventeenth Judicial Circuit in and for Broward County, Florida, and directed that the circuit court, within thirty (30) days of this order, appoint new counsel to represent appellant in the appeal in this Court. The circuit court shall immediately notify this Court upon appointment of new counsel. Within ten (10) days of the date of the circuit court order appointing counsel, appellant's appointed counsel shall file a notice of appearance in this Court. Upon consideration of appellant's motion for extension to file appellant's reply cross answer brief and motion to stay proceedings, it is ordered that the motion for extension to file appellant's reply cross answer brief is granted and appellant's counsel shall serve a reply cross answer brief on the merits and a reply to response to petition for writ of habeas corpus within thirty (30) days after appointment as counsel. Appellee's reply brief shall be served pursuant to this Court's Order dated January 13, 2004. (SEE SC03-1553 TO VIEW ORDER)
