The Court has now determined that oral argument should be granted and the above case is scheduled for oral argument at 9:00 a.m., Wednesday, May 3, 2006. A maximum of twenty (20) minutes to the side is allowed, but counsel is expected to use only so much of that time as is necessary. The parties shall file supplemental briefs with regard to the issue of the impact and application of Florida Statutes §775.021(4)(b), as amended in 1988, upon State v. Getz, 435 So. 2d 789 (Fla. 1983), if any, and if a double jeopardy violation exists in this circumstance to fully address whether relief should be retroactively applied.
